Trials & Appeals

When warranted by the size of the stakes or the importance of the issues, we try cases in state and federal courts across the United States. Recognized for its formidable courtroom presence and proven track record of success, our trial team represents public and private companies, governmental entities and individuals in connection with complex commercial, constitutional, fiduciary, and other disputes. Our appellate practice is distinguished by a rare combination of resources found at larger law firms with the depth and breadth of experience more often associated with boutique appellate practices.

More than 30 experienced trial lawyers blend a diversity of experience as former federal and state law clerks, prosecutors and regulators, law professors, and CPAs to win precedent-setting verdicts, including class actions and multiparty complex litigation cases throughout the United States. We have successfully represented six of the Fortune 25 corporations in actions such as breach of fiduciary duty, antitrust, securities and regulatory matters involving state and federal law.

Extending beyond cases where we served as trial counsel, our appellate practice encompasses engagements in which we were first retained in connection with an appeal, either as lead counsel, consulting counsel, or counsel for an amicus curiae. We are especially known for our extensive appellate work in cases raising cutting-edge constitutional or statutory interpretation issues. Recent appellate successes have clarified important points of law concerning the Fair Credit Reporting Act, the Illinois Property Tax Code, provisions of the Bankruptcy Code, and the Illinois Declaratory Judgment – benefiting corporations, hospital systems and financial institutions confronting similar challenges.

We are recognized leaders in this arena, having received accolades for our litigation prowess from Chambers USA and The Best Lawyers on America. Litigation partner and former firm managing partner Scott J. Fisher is a member of the prestigious Litigation Counsel of America; litigation counsel Michael D. Sher is a member of the exclusive American College of Trial Lawyers; and litigation partner and co-chair of the Litigation Department, Steven F. Pflaum, has been admitted to membership in the American Academy of Appellate Lawyers and is a former President of the Illinois Appellate Lawyers Association.
