NGE’s Insurance Policyholder Practice Group attended the 2025 American Bar Association Insurance Coverage Litigation Committee CLE seminar in Tucson, AZ, from March 5 to 8, 2025. This event covered the latest insurance law developments from top insurance professionals. Additionally, Angela Elbert, Chair of NGE’s Insurance Policyholder practice group, Partner Andrew May, Counsels Freya Bowen and Paul Walker-Bright, and Associate Ben Boris participated in several panel discussions throughout the event.
On March 6, Angela participated in the session “Not Following the Leader: Second Guessing Underlying Carriers’ Coverage Determinations,” which discussed when and how an excess carrier must follow an underlying carrier’s coverage decisions. Andrew also moderated “Clearing the Air: Navigating Insurance Coverage for Ethylene Oxide Litigation,” which explored the rise of Ethylene Oxide litigation and its evolving insurance coverage implications. Additionally, Ben moderated “From BIPA to GIPA: How BIPA Coverage Decisions May Influence the Availability of CGL Coverage for Emerging GIPA Class Action Suits,” which discussed the shift from BIPA to GIPA in privacy lawsuits and the implications for insurance coverage.
On March 7, Freya participated in “Is DEI Still Alive Post-SCOTUS 2023?” which discussed how corporations can balance DEI commitments with legal compliance amid shifting legal and societal landscapes. Paul also joined the roundtable session “The Rule of Contra Proferentem: What It Is, How to Apply It, and How to Spell It,” which examined the use of contra proferentem in insurance law, its limitations, and how factors, including extrinsic evidence and policyholder sophistication impact its use.
