These issues include choosing defense counsel, reasonable hourly rates, issues for policyholders with high SIRs or deductibles, when independent counsel of a policyholder’s choice is warranted, coverage for counterclaims, allocation of defense costs, litigation management guidelines, the tripartite relationship and the ability to pursue coverage issues while an underlying case is defended.
