Holby M. Abern is an intellectual property partner who concentrates his practice on all aspects of patent law, including prosecution, licensing, opinion work, counseling and due diligence.

Holby has obtained hundreds of computer software-related patents with claims focusing on systems, methods and memory devices that implement and execute various forms of computer software. Holby has drafted and prosecuted such computer software-related patents and patent applications across different industries ranging from the gaming industry to the travel industry. Additionally, Holby has drafted and prosecuted utility and design patent applications relating to a wide variety of technologies, including wind power turbines, cableway systems, tracked vehicles, medical devices, coatings, food packaging, consumer products, pet restraint devices, railroad car parts, handheld tools, work tables and snow throwers.

Holby provides his legal services with a full appreciation of the perspectives of in-house counsel, management and technical staff. Such legal services include routinely advising clients regarding patent infringement issues, patent invalidity issues and freedom to operate issues. His extensive legal experience and business knowledge enable him to efficiently advise and assist clients in maximizing their patent and other intellectual property protection.

Holby regularly works directly with patent examiners at the U.S. Patent and Trademark Office to focus prosecution by minimizing patent prosecution delays and maximizing the scope of patent protection for his clients.

To ensure his clients’ intellectual property assets are fully protected and capable of being leveraged throughout their business, Holby frequently attends client industry trade shows to better understand the businesses and opportunities of his clients and to counsel clients in enforcing their patents and avoiding infringement of competitor patents.
